Floodgate LLC d/b/a Surro Social™, Surro Strong™, and Surro™ (collectively, “we,” “us,” or “Surro”) values your privacy. This privacy policy (the “Privacy Policy”) describes how we collect, use, share, and protect personal information (“Information”) when you use and/or access our Sites (www.surrosocial.com, www.surrostrong.com, www.surrostrong.org), mobile applications (including Surro Social™), platforms (including, without limitation, our social media platforms), and related services provided on or in connection with any of the foregoing (the foregoing, collectively, the “Services”).​  This Privacy Policy applies to all of our Sites and Services and governs our use of your Information that we collect.  

This Privacy Policy explains how Information is collected and used by us and applies to the Information collected when you use or access any of our Sites or Services, including, without limitation, by voluntarily providing Information on any Site or in connection with any Service (including, without limitation, by interacting with us through any social media channel) or otherwise contacting or interacting with us on any Site or through or in connection with any Service.

By using and/or accessing any of the Sites and/or by using and/or accessing any of the Services, you consent to the practices described in this Privacy Policy.  Our Terms of Use (the “Terms”) also apply to our Users.  As more fully described in the Terms, by accessing and/or using any of the Sites and/or by accessing and/or using any of the Services, you agree to be bound by the Terms in all respects.  Capitalized terms used but not defined herein shall have the meanings ascribed to them in the Terms.  

1. Information We Collect

We collect certain information to provide and improve the Sites and Services, including: 

• Account & Profile Data: Name, email, phone, username, password, profile photo(s), background, surrogacy status, occupation, marital status, location, and other information shared as part of onboarding or your profile on any Site or Service.​
• Journal & User Content: Journal entries (public or private), social posts, posted photos, comments, messages, user feedback, event creations/RSVPs, interactions, subcommunity creations/memberships, and voluntarily provided pregnancy/health information and status.​
• Payment Data: For merchandise and accessories (Surro Strong™) and journal purchases, billing address, mailing address, and payment card info (processed via third-party gateways).​
• Communications and Interactions: Support inquiries, opt-in notifications (email/text), user requests and feedback, and interactions generally with us.​

• Usage Data, Analytics, Cookies/Trackers: IP address, device type, browser, OS, pages visited, time stamps, referral sources, analytics (aggregated interactions, etc.), and cookies/trackers (preferences, session data, etc.).  

• Information from Third Parties: App stores (Apple/Google), payment processors, and analytics providers.  

Our Sites and Services are not directed to persons under eighteen (18) years of age.  We do not knowingly collect data from any such person. 

2. How We Use Your Information

We use Information for legitimate business purposes, including with respect to the following:

• Provide and maintain our Sites and Services; 
• Process payments and fulfill orders; 
• Provide support to surrogates through direct grants (via Surro Strong Foundation); 
• Communicate with users (via notifications, updates, and improvements); 
• Improve our Sites and Services, including, without limitation, with marketing; 
• Prevent fraud and abuse; 
• Maintain legal compliance. 

We may share information, in furtherance of the above purposes, that you have voluntarily provided to us by using and/or accessing any Site or any Service, with: service providers (e.g., hosting, payments, analytics, email, moderation tools); affiliates and partners (including, without limitation, Surro Strong Foundation); successors and assigns; persons and/or entities for legal compliance purposes (e.g., court orders, law enforcement, rights/safety protections); persons and/or entities to whom your consent has been provided to us for sharing Information and User Content in accordance with the purposes set forth above.  

3. Data Retention

We reserve the right to retain Information, User Content, and other information for such length of time as we determine is needed or advisable for the purposes set forth above, including for compliance with legal and/or regulatory obligations and/or with respect to any disputes.  Upon account termination, data will be removed as soon as practicable (within thirty (30) days), with exception for backups and legal holds, if any).  

4. Security

We use reasonable administrative, technical, and physical safeguards (encryption, access controls, firewalls) as advised by the technical professionals who assist us with our Sites and Services.  Pease be aware, and you accept and acknowledge, that no system, including any Site or any Service, can be guaranteed to be fully secure and that you are solely responsible for password confidentiality and the Information, User Content, and other information you voluntarily provide to us through your access/and or usage of any Site or Service. We are not responsible, and you agree and acknowledge that we are not responsible for, for the practices of any third party.

5. Your Privacy Rights & Choices

In using and/or accessing any Site and/or any Service, you have the right to, as applicable, and in addition to any other rights available to you under applicable law: edit your profile and provided Information; edit your entries and posts; delete your entries and posts; deactivate your profile; end your usage and/or access to any Site and/or any Service; opt-out of reminder and marketing emails, texts, notifications, and cookies; toggle your Journal entries to private; and correct inaccuracies.  

6. Changes to This Privacy Policy

We may update this Privacy Policy at any time in our sole discretion, with any such updated Privacy Policy become immediately effective, and binding upon you (provided that you have continued to use and/or access any Site and/or any Service following our posting of the updated Privacy Policy), upon its posting to our Sites.
